1. About these Terms 

These Terms govern your use of www.purks.au, your purchases from Purks, and any orders placed via our marketplace listings (e.g., Amazon) or approved stockists (where their own terms may also apply). By accessing our website or placing an order, you agree to these Terms. 

2. Your account 

You’re responsible for maintaining the confidentiality of your account credentials and for all activities under your account. 

3. Products, pricing & GST 

All prices shown to Australian consumers are displayed as a single total price inclusive of GST and any mandatory charges, consistent with ACCC guidance on price displays. Optional charges like shipping are shown separately at checkout. 

4. Orders & acceptance 

Orders placed on our website are offers to purchase. We may accept or reject an order at our discretion (e.g., due to stock availability or suspected fraud). If we cannot fulfil an order, we’ll cancel and refund any amounts paid. 

5. Payment 

Payment is due at checkout via the payment methods offered. For marketplace orders (e.g., Amazon), the marketplace’s payment terms apply. 

6. Shipping & delivery 

We provide clear, upfront shipping costs consistent with local regulations. 

  • FREE freight applies to all orders over $150.
  • A flat $25 freight fee applies to all orders under $150.
  • Delivery estimates are provided in good faith. We follow ACL obligations to avoid misleading or deceptive conduct regarding delivery timeframes and to deliver goods within a reasonable time.

7. Title & risk 

Title passes to you when we receive full payment and accept your offer to purchase in the form of dispatch confirmation. Risk (including loss or damage) passes on delivery to your nominated address. 

8. Returns, refunds & consumer guarantees 

Our Returns Policy explains how to lodge returns, including change-of-mind conditions. Retailer returns will be subject to a 15% re-stocking fee. Freight charges will not be refunded for any returns. 

9. Promotions & gift cards 

Promotions may be subject to additional terms. Gift cards (if offered) are not redeemable for cash and lost or stolen cards will not be replaced. 

10. Intellectual property 

All content on the site (including trademarks, copy, graphics, and product images) is owned by or licensed to Purks. You must not use our IP without formal permission received in writing. 

11. Third party platforms 

When you purchase via Amazon or other marketplaces, their terms and policies apply in addition to ours; in case of conflict, marketplace rules usually govern the transaction on that platform. 

12. Limitation of liability 

Nothing in these Terms limits any rights you have under the ACL. Subject to those rights, and to the maximum extent permitted by law, we exclude liability for indirect or consequential loss or damage.  

13. Governing law 

These Terms are governed by the laws of Western Australia, and disputes are subject to the WA courts. 

14. Changes to Terms 

We may update these Terms from time to time. The version on our website when you order applies to that order.
